ARTICLE 1 - SCOPE OF APPLICATION
These General Terms of Sale (hereinafter referred to as the "Terms of Sale") shall apply without restriction or reservation to all sales concluded by the Seller with non-professional Buyers (the "Customers") who wish to purchase the products (the "Products") offered for sale by the Seller on its website foryoubynema.com.
The Products offered for sale on the site are the following:
- Jewelry
- Decoration
The main characteristics of the Products, and notably the specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the website foryoubynema.com, of which the Customer is required to read before placing an order.
The choice and purchase of a Product is the sole responsibility of the Customer.
Product offers are valid within the limit of available stocks, as specified when placing the order.
These Terms of Sale are accessible at any time on the site foryoubynema.com and shall prevail over any other document.
The Customer declares to have read and accepted these Terms of Sale by checking the box provided for this purpose before the implementation of the ordering procedure on the website foryoubynema.com.
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Products presented on the site foryoubynema.com are offered for sale for the following territories:
- Metropolitan France and the European Union (EU).
- The Rest of the World, subject to feasibility by our transport providers. The list of served countries is available and consultable on our page "Shipping Policy".
In the case of an order from a country other than Metropolitan France, the Customer is the importer of the Product(s) concerned.
For all Products shipped internationally, the price is net of French tax.
Customs duties or any other local taxes, import duties, or state taxes may be payable. They shall be borne by and are the sole responsibility of the Customer.
ARTICLE 2 - PRICING
The Products are supplied at the prices in effect and displayed on the website foryoubynema.com when the order is registered by the Seller.
Prices are expressed by default in Euros (€) for Customers located within the European Union (EU). VAT is not applicable, in accordance with Article 293 B of the French General Tax Code (CGI).
For orders placed outside the Euro zone, the price may be displayed in United States Dollar (USD) or in the Customer's local currency, for informational and non-contractual purposes only.
Currency conversion is carried out by our payment service provider according to the rate applied by the latter at the time of the transaction. The Customer is informed that this rate may include a slight markup compared to the market exchange rate.
However, the final billing and collection currency will always be specified before the validation of the order.
The final price paid by the Customer will be displayed in the settlement currency (EUR for the EU or USD/local currency accepted for other zones) at the moment of final validation.
The stated prices include any potential discounts granted by the Seller on the foryoubynema.com website.
These prices are firm and non-revisable during their validity period, but the Seller reserves the right, outside this period of validity, to modify the prices at any time.
The price does not include the costs of processing, shipping, transport, and delivery, which are billed in addition under the conditions indicated on the website and calculated prior to the placement of the order.
Payment for the purchase corresponds to the total amount of the purchase, including these aforementioned costs.
The Seller will provide a summary statement detailing the order elements. An invoice is not issued to the consumer Customer unless specifically requested by them, but it is systematically included with the Products.
ARTICLE 3 - ORDERS
The Customer is responsible for selecting the Products they wish to order on the foryoubynema.com website, following the steps below:
The Customer wishing to place an order on the Website must follow the following procedure:
Product Selection (Shopping Cart)
The Customer chooses the Product(s) they wish to purchase and adds them to their cart by clicking on the "Add to Cart" button.
The Customer can, at any time, review the summary of their cart, modify quantities, or remove Products before validating their order.
Account Identification or Creation
To validate their order, the Customer must identify themselves by logging into their personal account if they are already registered, or create an account if it is their first order, or proceed as a guest.
Delivery Choice
The Customer enters or verifies their delivery and billing information (names, complete addresses, and phone numbers).
The Customer selects the desired delivery method from the options offered (if more than one option is available), and takes cognisance of the associated deadlines and delivery fees.
Order Summary and Acceptance of the Terms of Sale
A complete summary of the order is displayed, including the nature of the Products, the total price, the amount of VAT (if applicable), and the delivery fees.
The Customer is required to check the accuracy of the order and has the possibility of correcting any errors.
The validation of the order implies the Customer's unreserved acceptance of these Terms of Sale, having acknowledged them prior to placing the order.
Final Validation and Payment
The final validation is made by clicking on the "Order with obligation to pay" button (or any similar formula guaranteeing the Customer that placing the order implies a payment).
The Customer is then directed to the secure payment system to settle the amount of their order. The order is considered final and the contract is formed upon the Seller’s receipt of the payment.
Order Confirmation
The Seller acknowledges receipt of the order and payment by sending the Customer an email confirmation detailing the essential elements of the order (order number, Products, price, delivery method and deadline, Seller's contact details, right of withdrawal).
Product offers are valid as long as they are visible on the website, subject to available stock.
The sale shall only be deemed valid after full payment of the price. It is the Customer's responsibility to check the accuracy of the order and to immediately report any errors.
Any order placed on the foryoubynema.com website constitutes the formation of a distance contract concluded between the Customer and the Seller.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute relating to the payment of a previous order.
The Customer may track the progress of their order on the website.
Any cancellation of the order by the Customer after its acceptance by the Seller will only be possible within 24 hours following the acceptance of the order, provided that the Product manufacturing process has not yet been launched, and that delivery has not yet taken place. (This is irrespective of the provisions regarding the application or non-application of the statutory right of withdrawal).
ARTICLE 4 - PAYMENT CONDITIONS
The price is paid via a secure payment method, in accordance with the following options:
- Payment by bank card (or credit card)
- PayPal, Apple Pay, Shop Pay
The price is payable in full by the Customer, on the day the order is placed.
ARTICLE 5 - DELIVERIES
The Products ordered by the Customer will be delivered in Metropolitan France or within the following zones:
- All countries of the European Union and the European Economic Area (EEA), as well as the United Kingdom, Switzerland, the United States, Canada, Australia, Japan, and other countries listed on the "Shipping Policy" page.
Payment data is exchanged in encrypted form according to the protocol defined by the authorized payment provider involved in the transactions carried out on the foryoubynema.com website.
Payments made by the Customer will not be considered final until the Seller has actually collected the sums due.
The Seller shall not be obliged to deliver the Products ordered by the Customer if the Customer does not pay the price in full, under the conditions set out above.
Deliveries, corresponding to the transport lead time, occur within an indicative period of 5 to 15 working days from the date of order shipment (and do not include the manufacturing and processing time). Exact lead times per geographical area (France, EU, International) are specified and available for consultation on the website's "Shipping Policy" page.
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product. Except for specific circumstances or the unavailability of one or more Products, the Products will be delivered in a single shipment.
The Seller undertakes to use its best efforts to deliver the products ordered to the Customer within the deadlines specified above.
If the Products ordered are not delivered within a period of 30 days after the indicative delivery date, for any reason other than force majeure or a fault on the part of the Customer, the Customer may formally request the Seller to complete the delivery within a reasonable additional period. If the Seller fails to deliver within this new period, the Customer may terminate the contract upon written request.
For Customers subject to the French Consumer Code: In the event of contract termination due to late delivery, the amounts paid by the Customer will be refunded to them no later than fourteen days following the date of contract termination, excluding any compensation or deduction, in accordance with Articles L 216-2, L 216-3, and L241-4 of the said Code.
Deliveries are carried out by an independent carrier, to the address specified by the Customer when ordering and to which the carrier can easily access.
If the Customer has arranged for their own carrier, delivery is deemed to have taken place upon the Seller's handover of the ordered Products to the carrier, provided the Customer has accepted them without reservation. The Customer therefore acknowledges that the choice of carrier is their responsibility and that the carrier is responsible for making the delivery and has no recourse against the Seller in the event of non-delivery of the transported goods.
In the event of a specific Customer request concerning the packaging or transport of ordered products, duly accepted in writing by the Seller, the associated costs will be subject to a specific invoice, based on an estimate previously accepted in writing by the Customer.
The Customer is required to check the condition of the delivered products. They have a period of three (3) working days from the date of delivery to formulate any claims concerning damage, errors, or visible non-conformities (apparent defects) by email to: contact@foryoubynema.com, accompanied by all relevant supporting documents (photos in particular). After this period and if the Customer fails to respect these formalities, the Products are deemed to be compliant and free from any apparent defect, and no claim can be validly accepted by the Seller. This provision shall not limit or exclude the Customer's rights under the legal guarantees of conformity and latent defects applicable under Articles L 217-4 et seq. of the French Consumer Code and Article 1641 of the French Civil Code.
The Seller will refund or replace, as soon as possible and at its own expense, the Products delivered that have been duly proven by the Customer to have defects in conformity or apparent or hidden defects, under the conditions provided for in Articles L 217-4 et seq. of the French Consumer Code and those provided for in these Terms of Sale.
The transfer of risks of loss and deterioration relating thereto shall only be completed when the Customer takes physical possession of the Products. The Products travel at the risks and perils of the Seller unless the Customer chooses their own carrier. In this case, the risks are transferred upon handover of the goods to the carrier.
ARTICLE 6 - TRANSFER OF TITLE
The transfer of title of the Products from the Seller to the Customer shall only take place after full payment of the price by the latter, regardless of the date of delivery of the said Products.
ARTICLE 7 - RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from the receipt of the Product to exercise their right of withdrawal with the Seller, without having to provide reasons or pay any penalty. The conditions for return and refund are specified in the Refund Policy Article.
Exceptions to the Right of Withdrawal:
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized.
Consequently, if the Customer orders a Product that is subject to personalization at their request (specific engraving, unique design, non-standard colour, etc.), the sale is considered firm and final upon placing the order, and the right of withdrawal does not apply to this Product.
ARTICLE 8 - SELLER'S LIABILITY - WARRANTIES
The Products supplied by the Seller benefit from:
- The legal guarantee of conformity for Products that are defective, damaged, or do not correspond to the order.
- The legal guarantee against latent defects resulting from a material, design, or manufacturing fault affecting the delivered Products and rendering them unfit for use.
Provisions Relating to Legal Warranties
Article L217-4 of the French Consumer Code
"The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity existing at the time of delivery. They shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made their responsibility by the contract or was carried out under their responsibility."
Article L217-5 of the French Consumer Code
"The goods are deemed to conform to the contract:
- If they are fit for the purpose usually expected of similar goods and, where appropriate:
-
- If they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- If they present the qualities that a buyer can legitimately expect having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;
2. Or if they have the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, made known to the seller and which the latter has accepted."
Article L217-12 of the French Consumer Code
"The action resulting from a lack of conformity is time-barred two years after the delivery of the goods."
Article 1641 of the French Civil Code
"The seller is bound by a warranty against hidden defects in the item sold which render it unfit for the purpose for which it was intended, or which diminish that use so much that the buyer would not have acquired it, or would have acquired it only for a lesser price, had they known about them."
Article 1648, Paragraph 1, of the French Civil Code
"The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect."
Article L217-16 of the French Consumer Code
"When the buyer asks the seller, during the course of the commercial warranty granted to them upon the acquisition or repair of movable goods, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining term of the warranty. This period runs from the time of the buyer's request for intervention or from the time the goods in question are made available for repair, if this option is later than the request for intervention."
Artisanal Variability: Given the artisanal nature of the manufacture and the fact that the Products are handmade, the Customer acknowledges and accepts that there may be minor differences in finish, in tint or texture between the ordered Product and its photographic representation, and that these differences do not alter the essential qualities of the Product.
In order to assert their rights, the Customer must inform the Seller, in writing (email), of the non-conformity of the Products or the existence of hidden defects from the moment of their discovery.
The Seller will refund or replace or repair the Products or parts covered by the warranty that are deemed non-compliant or defective.
The return costs will be refunded based on the invoiced rate and the return shipping costs will be reimbursed upon presentation of supporting documents.
Refunds, replacements, or repairs of Products deemed non-compliant or defective will be carried out within the shortest possible time and no later than 30 days following the Seller's determination of the defect of conformity or hidden defect. The refund can be made by bank transfer or bank cheque.
The Seller's liability shall not be incurred in the following cases:
- Non-compliance with the legislation of the country in which the products are delivered, which it is the Customer's responsibility to check.
- In case of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, such as in case of normal wear and tear of the Product, accident, or force majeure.
- The photographs and graphics presented on the website are non-contractual and cannot engage the Seller's liability.
The Seller's warranty is, in all circumstances, limited to the replacement or refund of Products that are non-compliant or affected by a defect.
ARTICLE 9 - PERSONAL DATA
The Customer is informed that the collection of personal data is necessary for the sale of the Products by the Seller, as well as for their transmission to third parties for the purposes of delivery of the Products. This data is collected solely for the execution of the contract.
The Customer is also informed that the collection of personal data is carried out for the following purposes:
Management of Customer Relationship and After-Sales Service:
- Purpose: Processing Customer requests, complaints, returns (right of withdrawal), and applying legal and contractual warranties.
- Legal Basis: Necessary for the performance of the sales contract (including after-sales service and compliance with legal obligations (warranties)).
Marketing, Direct Marketing, and Newsletter:
- Purpose: Sending commercial information about the Products, new products, or promotional offers, only if the Customer consents.
- Legal Basis: Based on Customer consent (if the Customer ticks the box to subscribe to the newsletter or during the order) or, where applicable, on our legitimate interest (for communications on similar products already purchased, if the law permits).
Site analysis and performance improvement (Statistics):
- Purpose: Measuring website audience and usage (page views, user journeys, etc.) to improve the Customer experience, product performance, and product offering.
- Legal Basis: Based on our legitimate interest (ensuring the proper technical functioning of the site and the continuous improvement of the service) or, if the site uses non-essential cookies, on user consent.
9.1 Collection of personal data
The personal data collected on the foryoubynema.com website are the following:
Product Order:
During the ordering of Products by the Customer: first names, last names, email and postal address (or more data for billing information), telephone number for deliveries.
Payment:
As part of the payment for the Products offered on the foryoubynema.com website, this involves the collection of financial data relating to the bank account or credit card of the Customer / user.
9.2 Recipients of personal data
The personal data are used by the Seller and its co-contractors for the execution of the contract and to ensure the efficiency of the provision of sale and delivery of Products.
The category(ies) of co-contractor(s) is (are):
- Transport providers.
- Payment providers (banks, Stripe, PayPal, etc.).
- Shopify.
9.3 Data Controller
The data controller is the Seller, under the terms of the French Data Protection Act (loi Informatique et libertés) and starting from May 25, 2018, the Regulation 2016/679 on the protection of personal data (GDPR).
9.4 Limitation of Processing
Unless the Customer expresses their express consent, personal data shall not be used for advertising or marketing purposes.
9.5 Data Retention Period
The Seller will retain the data collected for a period of five (5) years, covering the statute of limitations for the applicable contractual civil liability.
9.6 Security and Confidentiality
The Seller implements organizational, technical, logical, and physical security measures to protect the Customer's personal data against alteration, destruction, and unauthorized access. However, it should be noted that the internet is not a completely secure environment, and the Seller cannot guarantee the security of the transmission or storage of information on the internet.
9.7 Implementation of Customer and user rights
In application of the regulations applicable to personal data, Customers and users of the foryoubynema.com website have the following rights:
- They can update or delete the data concerning them in the following manner:

- They can delete their electronic account by writing to the address indicated in Article 9.3 « Data Controller ».
- They can exercise their right of access to know the personal data concerning them by writing to the address indicated in Article 9.3 « Data Controller ».
- If the personal data held by the Seller are inaccurate, they may request that the information be updated by writing to the address indicated in Article 9.3 « Data Controller ».
- They may request the suppression of their personal data, in accordance with the applicable data protection laws and policies, by writing to the address indicated in Article 9.3 « Data Controller ».
- They may also request the portability of the data held by the Seller to another service provider.
- Finally, they may object to the processing of their data by the Seller.
In the event of asserting these rights, when the data is incorrect or there is an objection to the finality, they can be exercised by mail or email to the Data Controller, whose contact details are provided above.
The Data Controller must provide a response within a maximum period of one month.
In the event of a refusal to grant the request, the Customer must be informed of the reasons for the refusal.
The Customer is informed that in case of refusal, they may introduce a complaint to the CNIL (3 place de Fontenoy, 75007 PARIS) or refer the matter to a judicial authority.
ARTICLE 10 - INTELLECTUAL PROPERTY
The content of the foryoubynema.com website is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly prohibited and is liable to constitute a counterfeit offense.
ARTICLE 11 - GOVERNING LAW - LANGUAGE
These Terms of Sale and the operations resulting therefrom are governed by and subject to French law.
These Terms of Sale are written in the French language. Should they be translated into one or more foreign languages, the French text alone shall prevail in the event of a dispute.
